Aplogies to all Injustice in Europe readers as it has been somewhat hectic lately and the e-mail box was inaccessable for a while. There have been several comments but perhaps this was the most interesting of all. It came in on the 23rd January 2009.

“Your web site has been brought to my attention, I will be taking the advice of my lawyers re the content of this page referring to a Miss Jensen who apparently was employed by the company Axar Properties.”

We are not surprised that this site was brought to Paula Basham’s attention. Have you tried to Google Axar Property or Axar Properties lately?

Injustice in Europe would like to point out to Paula Basham that Ms. Jensen was NOT “apparently” employed by the company Axar Properties, she WAS employed by Axar Properties.  You were her boss, you hired her and you fired her. You, as her boss were twice found liable in Malaga Court, once for wrongful dismissal of a pregnant woman, namely Ms. Jensen and you have not yet paid either of the fines that you were given.

Injustice in Europe, however, will happily remove and apologize for any factual errors should Paula Basham care to point them out.

Moving on…Axar Properties is no longer called Axar Properties but has cunningly changed the name to Axar Property. We would not want  you,  the readers, to be fooled or indeed confused between the two. Perhaps the Tax Department or the Social Security Department will be for a while but not the readers of Injustice in Europe.

Axar Property is owned by Paula Basham, as was Axar Properties S.L. The website has the same format as Axar Properties it even has many of the same properties on their website for sale as when Ms. Jensen worked there.

I wonder if she is missed.

Axar Property Closes the Door

English lawyer and estate agent, Paula Basham, proprietor of Axar Property, has been shut down for business, according to neighbouring business owners and clients.

Collectively,  they are outraged at the maltreatment of her staff  and also they were frustrated by lack of teeth and the sluggishness of the local judicial system which have convictions outstanding against Paula Basham and Axar Properties for some considerable time. 

“She gets what she deserves” was one comment.

English Lawyers in Spain, Can You Trust Them?

Certain English lawyers in Spain are not to be trusted.

It seems that they are willing to flout laws and bamboozle ex-patriots of whatever nationality with their superior knowledge of the law, language and common practices. 

This does not only apply to English lawyers in Spain of course but let us concern ourselves with them for the time being.

This blog has cited the case of Edward Kirwan who was to be railroaded from his home on the 21st January 2009 as the result of an illegal action brought by De Cotta Law on behalf of their client Valerie Celia Russell. 

International laws become something  of a joke when a judge sitting in Hastings in England can pronounce a judgement in a divorce case based on a Spanish property valuation. The valuation was proven false,  it was written in Spanish which is a language the judge could neither read, write nor speak. Yet  District Judge Pollard was able to do this… how amazing…

However, based on his superior knowledge of the law, his professional position and the fact that he had had an apartment and stayed in the Marbella or Puerto Banus area on his holidays, gave him, it appears,  sufficient understanding of the Spanish law to make a court order. 

Sadly, the court order was “mis-translated” by an Official Translator, Barry True and was used against Edward Kirwan, initially by Jon Sutton of DeCotta Law, to prevent him from honouring the court order. Interestingly, the official translation was acted upon several days before Barry True stamped it.

Time passed and DeCotta Law, on behalf of their client Valerie Celia Russell, appealed the decision of the Torrox Court on a technicality. De Cotta McKenna y Santafé had the appeal denied on 12th March 2009. 

De Cotta McKenna y Santafé have appealed again, this time to the higher court in Madrid…do De Cotta McKenna y Santafé really want to continue this charade? Do they want to defend their illegal action? The mind really boggles…or is it just another day in Surreal Spain?

I hear you shout “FRAUD” and you are not wrong…watch this space…

Wake up! There are ordinary intelligent individuals living and working in all parts of Spain and other countries in Europe, who are being exploited by  ”the system”. Why?

There are all manner of reasons but perhaps because they do not speak the language,  perhaps they do not understand the proceedures, perhaps they cannot afford to pay the fees of English lawyers in Spain but certainly they do not want to be exploited further.

Meanwhile, English Lawyer, Paula Basham and owner of Axar Property continues with business as usual with seemingly scant regard for the plight of her former employee (or as we are now noitfied employees).

Paula Basham is totally refusing to acknowledge or respect the heavy fines imposed on her by the Court in Malaga for her illegal actions.

Although the “office staff” at Axar Property have their lips tightly sealed, possibly through fear,  it appears nothing much has changed there in regard to employee’s rights and employer obligations. 

The misery and suffering these English lawyers in Spain have caused in the instances cited  above is quite beyond measure.

Anyone might forgive drunken louts behaving in this fashion but the action of these educated and presumably cold sober professionals brings disgrace to the English people and makes it  a shame to be known as English.

 

Is Axar Properties above The Law?

Injustice in Europe asks if Axar Properties is above the law?

Having lost two court cases and owing her ex employee thousands of euros, an English lawyer in Spain, Paula Basham carries on business as usual as the owner of  Axar Properties.

What this entry on Google fails to tell you is that Axar Properties employed Vanessa Kjaerulff Jensen  full time and she acted as secretary, translator and sales woman, yet was only willing to give a contract as a part time cleaner!

The result of Paula Basham’s actions has left a respectable, hardworking and capable young mother without her rights to social benefits after being unlawfully dismissed from the employment of Axar Properties.

NOW, Paula Basham’s ex- employee along with her young daughter is forced into homelessness. Axar Properties, according to Vanessa Kjaerulff Jensen’s lawyer, has no money in their account to pay the two sums of money owing…this raises many questions.

These sums are not inconsiderable. They amount to 4 thousand euros and 11 thousand euros...but Axar Properties boss , Paula Basham will not pay.

This is a total disgrace, outrage and a bad reflection  on all English lawyers in Spain. Perhaps other English law firms will be interested in how their name is being brought into disrepute by the owner of Axar Properties.

As it is, Axar Properties continues to do business under the ownership of English Lawyer, Paula Basham.

Axar Properties…Pays Decent Wages…

That would be a great headline and music to the ears of many people generally in employment in Andalucia, including Vanessa Kjaerulff Jensen.

If Vanessa had been given the correct contract of employment and had not been unlawfully dismissed during her pregnancy  she would not be in the position she is in now.

Her financial position is desperate. It is desperate because Paula Basham of Axar Properties did not honour her word when she employed this tri-lingual young lady as a “trainee secretarty” (for want of a better expression) who turned out to be not only a useful secretary, she filed, she updated the website, she took in cash rental payments, she “meeted and greeted”  clients, she even went out on site visits with these clients as a Danish/English translator. Vanessa made sales for Axar Properties!

Did I mention …Vanessa Kjaerulff Jensen was not a cleaner…and anyway, there are plenty of fine cleaning companies Axar Properties could employ and who would be happy to give a proper tax receipt.

Vanessa has won TWO court cases in Malaga Court against Axar Properties and has NOT received one centimo from her employer, Paula Basham.

Vanessa has been to every official office, week after week with her young baby in arms to fill out form after form only to be told that her claim cannot be processed because she did not have a proper work contract. Even with the court papers in hand and assistance from her lawyer she cannot get the finacial help she is entitled to and  is desperatrely in need of because Axar Properties , apparently, has no money in its accounts.

As it is, Axar Properties continues to do business under the ownership of English Lawyer, Paula Basham.

Does she have any staff under contract now, we wonder.
